Two men who were investigated over a fatal crash involving a mobility scooter and a military truck have been released without charge.

John Robert Mitchell, 70, was riding the scooter when it collided with the truck near Colburn, close to the British Army base at Catterick Garrison, on 11 June last year.

The driver and passenger were questioned by North Yorkshire Police but the force has now confirmed no further action will be taken against them.

"All parties have been updated, and the matter has been passed to the coroner," a spokesperson said.

Mitchell, who was from Catterick Garrison, was airlifted to hospital after the crash on the A6136 Catterick Road, near the junction with Colburn Lane, but died during the journey.

The Ministry of Defence has been approached for comment.

A North Yorkshire Police spokesperson added: "An extensive collision investigation has been completed into the tragic death of Mr Mitchell.

"It concluded that no further action will be taken against the two men who were in the military truck. They have been released without charge."

Mitchell's family described him as a "much-loved husband, brother, uncle and godfather" who would be "sadly missed".

He was well-known in Colburn, where he was involved with the sports centre and village hall.
